NEWEGG SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE SUBSCRIPTION PROGRAM OR THESE TERMS WHICH EXCEEDS THIS LIABILITY LIMIT.
